I've been reconstructing the procedural history of an 11th Circuit appeal filed under a Canadian national's name (rendered to US custody from Canadian soil in September 2006 without consular notification).

Appeal 07-13206 (11th Cir., decided June 6, 2008) holds that VCCR Article 36 "remedies are unavailable" to individual foreign nationals. Three things I'd like a second legal opinion on:

1. The notice of appeal is dated February 28, 2007 — twelve days before the 7th Circuit decided Jogi v. Voges (480 F.3d 822, March 12, 2007). Jogi affirmed individual Article 36 rights under § 1983. The 11th Circuit ruling closed the Jogi framework for Florida, Georgia, and Alabama a year later.

2. The named plaintiff never signed the notice. He was in federal custody and had been verbally threatened by the AUSA with additional prison time if he pursued ineffective-counsel or VCCR claims. The appeal was filed anyway, in his name.

3. The holding is in direct conflict with LaGrand (ICJ 2001) and Avena (ICJ 2004), both of which the US is treaty-bound to respect under UN Charter Article 94.

ADDITIONAL FACT: the same person was simultaneously approved by USCIS for lawful permanent residence — which is administratively impossible under INA § 212(a)(2) with a federal drug conviction, strongly suggesting the BOP biometric file does not match his actual fingerprints.

If the signature absence checks out at PACER, the ruling appears void ab initio for fraud on the court under United States v. Morgan.

RCMP records appear to have been modified post-hoc.

Canada ratified the ICCPR Optional Protocol in 1976, so individual communications are admissible. Before I draft that, I want to confirm the domestic-remedies-exhaustion posture under Art. 5(2)(b) of the Optional Protocol. My tentative reading is that when the state party has itself obstructed remedies (charges dropped to prevent disclosure, database tampering making evidentiary review impossible), the exhaustion requirement is excused.

Three generations of documented legal business in Clearwater Beach, FL.

The anomalies:

2. The notice bears my printed name but not my signature. I was in federal custody, had been threatened with additional prison time by the AUSA if I pursued VCCR or ineffective-counsel claims, and never authorized the appeal. If the signature absence is confirmed at PACER, the ruling is void ab initio under United States v. Morgan, 346 U.S. 502 (1954).

The ruling is in direct conflict with LaGrand (ICJ 2001) and Avena (ICJ 2004), both binding on the United States under UN Charter Article 94.

Separately, USCIS approved my application for lawful permanent residence — administratively impossible with a federal drug conviction under INA § 212(a)(2). This strongly suggests the BOP biometric file does not match my actual fingerprints.
